KugelAudio is a Berlin text-to-speech API operated by KugelAudio GmbH (HRB 277989 B, Amtsgericht Charlottenburg, registered August 2025), and its paperwork is unusually complete for a company this young: two public DPAs (EU and Global, both dated 19 August 2026), a sub-processor register per DPA variant, a zero-data-retention clause for text and audio, and a published controls list. Under the EU DPA, which applies by default to organisations created in the EU/EEA and which the vendor brands as "EU Sovereign Cloud" (its own contract variant, not a hyperscaler sovereign-cloud product), speech content runs only on Verda (FI), Hetzner (DE), Nebius (NL), Contabo (DE), OVHcloud (FR) and Scaleway (FR); AWS, Google Cloud, Microsoft Azure and Lambda appear only in the Global DPA for customers outside the EU/EEA. The score is held at 3 by ownership: the Berlin shareholder list filed on 27 April 2026 shows that all shares in the GmbH are held by KugelAudio Inc., a Delaware corporation, the usual Y Combinator structure, so the processor has a US parent and CLOUD Act exposure is material regardless of the EU-only GPU chain. Further US links: Contabo is majority-owned by KKR (US private equity), account and billing data sit with Supabase (Singapore entity of a US-parented group), and the privacy policy names Intercom, PostHog, Stripe, Google and Vercel for support, analytics, payments and web infrastructure. No ISO 27001 or SOC 2 yet; the DPA states both are on the roadmap. The MIT-licensed open-weights model and the Enterprise on-premise option keep content inside the buyer's own perimeter.

KugelAudio est une plateforme de synthèse vocale en temps réel développée à Berlin par KugelAudio GmbH, fondée en août 2025 par Kajo Kratzenstein et Viktor Presber et passée par la promotion Spring 2026 de Y Combinator. L'API diffuse la voix en streaming via REST et WebSocket dans 39 langues, avec clonage de voix, contrôle de la vitesse, jetons de pause, notation API, dictionnaires de prononciation et horodatage au niveau du mot ; l'éditeur fournit des SDK Python, JavaScript et Java ainsi que des intégrations pour Pipecat et LiveKit. Deux modèles hébergés sont facturés à la minute générée, décomptée à la seconde : kugel-2-turbo à 0,035 € et kugel-3 à 0,07 € la minute hors TVA, avec une offre gratuite sans carte bancaire. Les contrats Enterprise ajoutent une capacité dédiée et un déploiement sur site. Un modèle antérieur, kugelaudio-0-open, est publié sur Hugging Face sous licence MIT ; il s'appuie sur le modèle ouvert VibeVoice de Microsoft et a été entraîné grâce à la puissance de calcul du centre de services IA du HPI, financé par le ministère fédéral allemand de la Recherche.
La documentation contractuelle est plus complète que chez bien des éditeurs plusieurs fois plus grands. Deux DPA publics coexistent, une variante UE et une variante Global, tous deux datés du 19 août 2026 et lisibles sans connexion, chacun avec son propre registre de sous-traitants dans le centre de confiance. Les organisations créées dans l'UE/EEE reçoivent par défaut le DPA UE, que l'éditeur présente comme « EU Sovereign Cloud ». Le terme désigne une variante contractuelle propre à KugelAudio et non l'offre de cloud souverain d'un hyperscaler : les contenus vocaux sont traités chez Verda (Finlande), Hetzner, Nebius, Contabo, OVHcloud et Scaleway, les références vocales sont stockées dans le stockage objet de Hetzner et de Scaleway, le texte et l'audio ne restent qu'en mémoire vive en vertu d'une clause de non-conservation, et AWS, Google Cloud, Microsoft Azure et Lambda sont exclus. Ces quatre fournisseurs n'apparaissent que dans le DPA Global destiné aux clients hors UE/EEE, cantonnés à des régions européennes. Lors de l'audit, l'API publique répondait depuis des serveurs Hetzner et Verda situés en Finlande, avec une terminaison TLS directement sur l'infrastructure d'entrée de l'éditeur et sans CDN en frontal, ce qui correspond à la description du DPA. Deux entrées du registre UE méritent un examen attentif : Contabo appartient majoritairement depuis 2022 au fonds d'investissement américain KKR, et Supabase, qui détient les données de compte et de facturation, est contracté via une entité de Singapour. La politique de confidentialité cite par ailleurs des services américains qui touchent aux données de compte et de support, mais pas aux contenus vocaux : Intercom pour la messagerie intégrée, PostHog pour l'analyse produit et l'enregistrement de sessions, Stripe pour les paiements, Google et Vercel.
Le fait déterminant est l'actionnariat. Selon la liste des associés déposée au registre du commerce de Berlin en avril 2026, la totalité des parts de KugelAudio GmbH est détenue par KugelAudio Inc., une société du Delaware domiciliée à San Francisco, structure habituelle pour une entreprise Y Combinator. La GmbH allemande est la partie contractante et le sous-traitant, mais elle se trouve sous une société mère américaine : l'actionnariat est donc classé Siège UE, financement US et l'exposition au CLOUD Act Significative. La chaîne de fournisseurs exclusivement européens répond à la question de savoir qui exploite les GPU ; la société mère est une autre question, et l'annuaire applique la même lecture à tout opérateur européen doté d'une société mère américaine. Aucune certification de sécurité n'est encore détenue ; le DPA cite ISO 27001 ou SOC 2 Type II comme objectif. Convient surtout aux équipes qui construisent des agents vocaux en langues européennes, tiennent à une chaîne d'infrastructure européenne pour les contenus vocaux et peuvent travailler avec une société mère américaine. Les acheteurs dont les règles excluent une société mère américaine auront intérêt à auto-héberger le modèle MIT sur une infrastructure GPU européenne ou à étudier le déploiement sur site, qui garde les contenus dans leur propre périmètre.
