Why do European public bodies use Element/Matrix instead of Discord?
Because the self-hosted, end-to-end-encrypted model fits sovereignty requirements that a hosted US community platform cannot meet. Element is built on the open Matrix protocol, is open source, and can be self-hosted on EU infrastructure, which is why the German Bundeswehr (BwMessenger) and the French government (Tchap) run on it. Self-hosted on infrastructure you control, CLOUD Act exposure is Material (none), and Matrix rooms can be end-to-end encrypted for text as well as calls. Discord, owned by Discord Inc., is US-incorporated with direct exposure, and its own encryption stops at voice and video.
Does Discord fall under the US CLOUD Act?
Yes. Discord is operated by Discord Inc., a US-incorporated company headquartered in San Francisco, so it is directly within the reach of the US CLOUD Act (Clarifying Lawful Overseas Use of Data Act) regardless of where a given server's data happens to sit. Discord names Discord Netherlands B.V. as the data controller for EEA residents and relies on standard contractual clauses for transfers, so it is legally usable from the EU; the alternative search is about removing the underlying US-jurisdiction exposure that a Schrems II assessment must document, which an EU-facing entity and SCCs alone do not do.
Does Discord encrypt messages end-to-end?
Only partly. Discord's DAVE protocol brought default end-to-end encryption to voice and video calls, including DMs, group DMs, voice channels and Go Live streams. Text messages and server text channels are explicitly excluded: Discord has said this is deliberate, because its content-moderation and safety tooling assumes message content is readable by the platform. Matrix, the protocol Element is built on, takes the opposite default: rooms, including text rooms, support end-to-end encryption, which is one of the clearer factual gaps between the two.
What's the difference between Element Cloud and self-hosted Element?
Element Cloud is the managed, vendor-hosted service; its primary hosting runs on AWS and it uses some US sub-processors, so its CLOUD Act exposure is Material (material), even though message content stays end-to-end encrypted. Self-hosted Element (a Synapse or Element Server Suite homeserver on EU infrastructure) removes that exposure entirely. The sovereignty case for Element rests on the self-hosted path; the managed cloud trades some of that away for convenience.
Can I migrate a Discord community to Element?
Structurally, yes: a Discord server maps reasonably well to a Matrix space, with text and voice channels becoming rooms and Discord's role-based permissions becoming Matrix power levels. The harder part is not technical but social. Discord communities are held together by network effects, so a migration means asking an entire external community, not just a team, to follow you to a new client and, for a public server, to accept losing Discord's built-in discovery. Bots and integrations generally need to be rebuilt for Matrix rather than ported directly.
Does Element match Discord on features?
Not for gaming-oriented communities. Discord's rich presence, game-activity integrations, Nitro perks and a much larger third-party bot ecosystem have no close equivalent on Matrix, and Discord's voice UX for large public communities is more polished. Element's advantages are structural rather than cosmetic: federation, self-hosting, and end-to-end encryption that covers text as well as calls. If your priority is a large, free, game-centric community space, Discord still leads; if it is sovereign, encrypted communication you control, Element is built for that and Discord explicitly is not.
